Ann Levey

This is the last Will and Testament of me Ann Levey of Manewden in the County of Essex Spinster IMPREMIS I give and devise all and singular my Messuages Lands Tenements Hereditaments and real estate whatsoever and wheresoever unto and to hold unto and to and for the only proper and absolute use and behoofe of my Brother James Levey and his heirs and assigns for ever And as to for and concerning my personal Estate I first will and direct that all my just Debts and plain but decent Expenses of my Funeral and the Expenses of the Probate hereof shall be first paid and then the following Legacies thereof by my Executor the said James Levey or such other here in after appointed in Case of his Decease as shall be acting hereunder at the End of twelve Calendar Months next after the Day of my Decease to such of my Legatees as shall be then living and of full Ages of Twenty one Years or otherwise to such in their any or other of their stead who and here in after named that is to say to my Brother John Levey fifty Pounds and every and any his sureties to me for any moneys whatsoever shall be forthwith after my Decease delivered up to him and I do hereby for give revise and release to him and discharge him entirely of from and against every and any his Debts to me and my Demand or Demand of my Executor acting under me upon him of what Nature and Kind soever Item to my two Nieces Mary Marknuth ? and Elizabeth Luies? Daughters of my late Sister Sarah Hollingsworth deceased and who I believe to be now of their full Ages the Sums of ten Pounds apiece but in Case either or both of them shall be deceased before such twelve months End then I give ?? their ten Pounds to my said Brother John Levey if then living and if not unto all amongst his lawfull Children or Child Item to my two Nieces Mary Levey and Ann Levey and my two Nephews, William Levey and Robert Levey Children of my late Brother Thomas Levey deceased all of whom I believe to be now their full Ages the sums of ten Pounds apiece but in Case all or any or either of them shall be deceased before such twelve Months End then I give their his or her Ten Pounds to my said Brother John Levey if then living and if not unto or amongst his lawfull Children or Child then living to be paid at twenty one if then Minors or a Minor but without any Interest in the ?? or ?? Item to my two Nieces Isabella Levey and Maria Levey and my three Nephews Robert Levey, Thomas Levey and William Levey Children of my late Brother Robert Levey deceased all of whom I suppose to be now Minors the Sums of Ten Pounds apiece But in Case all or any or either of them shall be Minors at such twelve Months End next after the Day of my Decease then his or her Ten Pounds shall be reserved in my said Executor's hands while and as each of them shall sevirally successfully attain the full Ages or Age of Twenty one or if females or a female shall be lawfully married when each Ten Pounds shall be paid to each but without any Interest during or fore all in respect of the intervening ?? or ?? save as to the said Nephew Robert's son of Robert his Ten Pounds which he now being abroad shall be reserved by my said Executor and paid him if of full Age when he shall return And in Case all any or either of them my last named Niece or Nephew shall be deceased before their his or her respective Attainments or Attainment of their his or her Ages or Age of twenty one then I give their his or her Ten Pounds to my said Brother James Levey if then living and if not unto or amongst his lawful Children or Child to be living at the time of his Decease to be paid at Twenty one if then Minors or a Minor but without any Interest in the Interim Item to my Niece Margaret Levey Daughter of my said Brother James Levey the Sum of Twenty Pounds But in Case she be a Minor at such twelve Months End then the same shall be reserved in my said Executor's Hands to be paid to her at or upon her Age of Twenty one years or Day of lawfull marriage which shall first happen without any Interest nevertheless for the Interim And in Case she shall be deceased before such twelve Months End or full age or Day of such marriage Then I give her said Twenty Pounds to her said Father James Levey if living and if not to his lawfull other Children or Child under the like former Directions Item I give and bequeath to my same Niece Margaret my Bed with all the Furniture thereto belonging all my Linnen all my Wearing Apparel Plate China and Household Furniture of what Nature or Kind soever and wheresoever to be safely preserved for her by her said Father until of age or married so as aforesaid and on Decease before to become and be his or his Childrens as aforesaid Item I give all the Rest and Residue of my Chattels and personal estate unto my said Brother James Levey whom I'll appoint whole and sole Executor hereof save only that in Case he shall happen to depart this life before all the Directions or Trusts of and in this my Will shall be entirely performed Then I do appoint in his stead my much esteemed Friend Mr Thomas Cole of Manewden aforesaid Shopkeeper the sole executor hereof and I do give him five Pounds forthwith on his beginning to act as such as some Acknowledgement to him to Act And in Case of his the said Thomas Cole's Decease before his Time or turn com?? Then I do appoint in his stead my Friend Robert Bull of Stansted Mountfitchet Essex Wheelwright the sole Executor hereof with alike five Pounds to be paid to or retained by him on his beginning to act as such And I hereby will and direct that neither of my said Executors to act in Isolation as aforesaid shall be answerable for any involuntary losses or loss nor for the Acts or Deeds of the other but each of them only for any his own wilfull Neglect or Default and each of them shall be entitled to retain Expenses and liberal Satisfaction for his Trouble in Acting And Lastly hereby I do revoke all former Wills Provided always and notwithstanding any thing hereinbefore contained that in Case any Deficiency shall happen in my Chattel or Personal Estates my said Brother James Levey his Heirs or Assigns do and shall my to Freehold Messuages only now held by William Bentley ? only sell parcell of my Real Estate in order to make up such Deficiency and so much thereof shall be charged with and liable to the Payments of and so that all my said Legacies may and shall be paid and the Produce by such Sale or Sales shall answer the same accordingly. And I do now make and declare this to be my only last Will and Testament In Witness whereof I have set my Hand and Seal this twenty eighth day of December in the Year of our Lord Christ one Thousand seven hundred and Eighty two Ann Levey Signed sealed published and declared by the said Ann Levey the Testatrix as and for her only last Will and Testament in the presence of us who at her Request in her Presence and in the Presence of each other have subscribed our Names as and for Witnesses hereunto the words between the 4th and 5th lines at the top of this Page being first interlined John Usher K Beaumont John Beaumont

Proved on the twenty fifth day of March in the Year of our Lord one Thousand seven hundred and eighty four before the Reverend Michael Wallace Clerk Surrogate by the Oath of James Levey the Brother of the Deceased and one of the Executors to whom Administration was granted he being first Sworn duly to Administer power being reserved of making the like Grant to Thomas Cole the other Executor named in the said will after the Decease of the said James Levey if he shall then lawfully apply for the same.
